Will it all come down to 'No Deal' or 'No Brexit'?!

Will it all come down to 'No Deal' or 'No Brexit'?! Brexit deal 'impossible' claims Number Ten source!

Now, if true, this is the big news of not just today, but possibly the biggest news of Brexit itself.

It is reported that the UK Prime Minister, Boris Johnson, had a telephone conversation at about 8 am this morning with the German Chancellor, Angela Merkel, and some of the details of that conversation have been leaked by an unnamed Number Ten source.

And the essence of it, is that Merkel told Boris that it was 'overwhelmingly unlikely' that a Brexit deal could be agreed based on the UK government's latest proposals.

And further, it is claimed that Merkel said a deal would never be possible unless Northern Ireland remained in a customs union with the EU permanently.

And that of course would mean Northern Ireland being hived off the UK and becoming part of the EU, which takes us back to statements made since the early days of the Brexit negotiations that Northern Ireland would have to be the cost we pay for a Brexit agreement.

And it is this, I think, that has led to the Number Ten source saying that it was now 'essentially impossible' to get a Brexit deal with the EU.

And that's why I think this is such a pivotal moment.

Because without the UK surrendering Northern Ireland to Brussels, there can never be a deal. With the really important bit to hoist in, being that it would not matter how the people of Northern Ireland themselves felt about it.

So, the Republic of Ireland and the EU are using the Good Friday Agreement as a weapon in the Brexit negotiations, but would completely ignore it if it meant they could get their sticky paws on Northern Ireland. Such breathtaking arrogance.

So, if Boris Johnson makes it crystal clear to Merkel that the UK will never accept those terms unless it is a free choice made by the people of Northern Ireland, then there is no point in further negotiations and also absolutely no point in lengthening the Article 50 process for another second via yet another Article 50 extension.

So, to cut to the chase, this means that the pro-Remain UK parliament will have just 17 days to act after it reconvenes on the 14th of October, after it is prorogued today.

Both our noble Lords and MPs will be faced with what they see as the real threat of an imminent and catastrophic no-deal Brexit that could be forced on the UK by the EU refusing any more time.

This of course would make any ruling by either the Court of Session or the Supreme Court completely irrelevant.

And with current legislation saying they will have to wait until the 19th of October with then only 12 days left to Brexit Day, to see if Boris Johnson abides by the terms of the Benn Surrender Act and actually sends the pre-scripted Article 50 extension request letter, it may be too much for their jangling nerves to stand.

The Remainers will be thinking to themselves whether or not Boris might have done enough to actually get one or more of the EU27 member states to reject the request.

Therefore, Queen's Speech or not, I think a group of Remainers will crack and start pushing the Speaker, John Bercow, for an emergency Standing Order 24 debate to lead to a vote on revoking the Article 50 letter together with the required legislation.

Somehow I can't see Bercow saying no to that, can you?

And remember that the House of Lords will gear itself up to very quickly pass such an Act were it ever to be presented to them - saying that they're just complying with the wishes of the Lower house. With the only question being how many MPs would be happy to go on public record as having voted for such a thing.

Now, if the EU sees something like this developing, they will make noises about the difficulty of getting an agreement amongst the EU27 to extend. And that might spur on more MPs to get behind any revocation plot.

In fact I would think that these sorts of scenarios have more likely than not, been comprehensively war-gamed by all sides.

So, this interjection today could end up meaning that the final round will be a simple vote by MPs in the House of Commons on the question of, is it to be 'no deal' or 'no Brexit'.
