"Given the nature of the conduct by and between the two panies thus far in this case as well as Respondent now questioning the validity of its own statements as explored in the previous paragraph, this Court travels two logical paths to the same conclusion. Either the 12 pages of disclosed incident reports are part of the “withheld 13 pages of documents” as discussed in the March 23, 20 Response or they are not. No matter whether the twelve (12) pages of incident reportss are part of, or separate from, those thirteen (13) withheld pages, the same result occurs: by Respondent’s own declarations, there is at least one extra page that has been withheld from Plaintiff to which Plaintiff has right to receive."
